The recount shows Busby by 53 votes for the Democratic nomination for district judge in Pontotoc County after a 9 vote gain in Bolen’s challenge. Judge Tal Crawford's restraining order blocks certification while Bolen seeks injunction dissolution.
Judge T G Chambers as special judge ruled Tal Crawford county judge lacked authority to dissolve an injunction against election boards but dissolved it and said court cannot enjoin a duty bound election official. Judge J W Bolen gave notice of appeal with $500 bond and time to file the case and appeal. Bolen seeks injunction against issuing a certificate of nomination to Busby after defeat by Busby in the Democratic primary.
In Shawnee on Aug 17, Charles J. Wrightsman Tulsa oilman and Henry S. Johnston Democratic nominee for governor held a late night conference. They outlined farm and rural education planks and urged party harmony ahead of the September state convention.
Frisco patrons teachers and pupils gathered under the Nazarene tabernacle for a well attended community meeting. A noon dinner, a girls chorus program and talks by Prof. John Zimmerman and Harry Miller highlighted the event. Oklahoma City August 18 Judge James S Davenport of Wichita won the Democratic nomination for judge of the criminal court of appeals by a plurality of more than 2000 votes in the August 3 primary. Davenport 12459 Wallace 10437 Cook 10073 Keenan 10120 Bessey 8746. Bessey filed an injunction to halt certification and void the nomination alleging Anti-Saloon League funding. Keenan denied league support.
District Judge J. W. Bolen named defendant in three district court suits totaling 61450 filed by A G Winn and Mrs Emma Shahan. Shahan claims eviction from Bolen farm near Stonewall and seeks damages for loss of crop health and reputation plus jail costs. She also alleges slander about her and her children. Winn seeks damages over an August injunction alleging conspiracy in the primary election and a $1000 allegation.
Oklahoma City reports a heavy rainfall event ending a drought with 2.75 inches in one night and 2.90 inches in 24 hours. Temperatures dropped from 82 to 67 degrees. Hay was ruined and cotton damaged in some areas, while other crops benefited. State agricultural officials say rainfall fell where needed, aiding the cotton crop which is expected near 1.6 million bales valued around 135 million dollars.

Pontotoc County plans a big agricultural show with a new park ready by September 15. The Pontotoc County Free Fair Association leaders include L W Estes J W Davis and W J Coffman. Township fairs will run from September 6 to 11 in Allen Fitzhugh Francis Maxwell Midland and Stonewall townships.
The Russell tax protest bill drew 3 075 votes for in Pontotoc county with 1 333 against and 649 blank ballots. Including silent ballots the opposition rises, leaving only a slim county majority in favor of the measure.
Two naval ensigns died when a seaplane diving over Lake Michigan near the Great Lakes Naval Training Station plunged into the water. The victims are Ensign George Hammer of Texas and Ensign Edgar T. Stone of Howard.

The county election board certified the returns and mailed them to Oklahoma City after a ruling dissolved an injunction against certifying Busby as district judge candidate. Bolen's side appealed to the supreme court. hearing postponed to next Tuesday. Many see this as the final contest for the Democratic nomination with Busby not appearing on November's ticket.
The Norman American Legion post plans to finish collecting pledges for the Child Welfare drive aiding orphans of World War veterans. Over a thousand dollars remains in Pontotoc County. Harold Constant M P Bentley Jr and Slade Norman head the drive with E W Marland promising 200000 cash and a townsite if all pledges are paid by September or October.
Former Gov. J C Walton refused to confirm or deny a report he might bolt the Democratic ticket to back the Republican candidate. He called the story a plain lie and said he would make no statement until the state election board certifies nominations. He noted he is focused on his oil business for now.
