Virginia Supreme Court Orders New Trial in Capital Murder Case

The Virginia Supreme Court overturned Major Henry Johnson Jr.’s 1978 capital murder conviction and ordered a new trial. It ruled Circuit Judge Ernest Ballou erred by instructing the jury that Johnson could be found guilty of capital murder even without pulling the trigger. Johnson, then 26, and his younger brother David Allen Johnson were involved in the Roanoke killing during a robbery of John Gardner.
