Northern Lumber Company V. O'Brien Heads To Supreme Court
The U S Court of Appeals for the Eighth Circuit decision was affirmed by the Supreme Court in the North ern Limber Company v. William O'Brien and others case. Originating in the Duluth land district, it involved a conflict between the Northern Pacific Railway and settlers under the land grant. The lumber company claimed the eight acre tract but withdrawal in favor of the Mississippi and Superior affected the acquisition, though proof showed the other road never possessed it. O'Brien and partners had taken possession via scrip in place of forest reserve land, while the lower court ruled the land part of the public domain and awarded title to them.
