Surgeon Liable for Major Surgery Without Patient Consent

A Chicago Appellate Court ruling holds a surgeon guilty of malice and liable for punitive damages for performing a major operation without the patient’s consent. Dr. B. H. Pratt was found liable in a case where Mrs. Parmela A. Davis became insane after an operation she did not agree to, despite her husband’s involvement. The decision emphasizes that patient consent is required unless in an emergency, and consent from relatives does not suffice.
