Iowa Use Tax Ruled Invalid In Extraterritorial Reach
Des Moines May 14 A Iowa Supreme Court ruling held the state use tax unconstitutional to the extent it targets articles bought outside Iowa for Iowa use. The decision, 4 to 3, says Iowa cannot regulate Sears Roebuck activities outside the state, with Montgomery Ward bound by mutual agreement. Sears Roebuck annual mail order business in Iowa totals about 5.5 million dollars, and the tax would be roughly 110 thousand dollars.
