Fence Cutting Case Dismissed by Judge
MONTEZUMA Iowa UPI A $10 000 damage suit against Osksloosa sheriff William J Welsh and Brooklyn school superintendent Herbert Haas over alleged false arrest of 6 year old Carl Amos Kilmer was dismissed by district judge L R Carson. The judge held Kilmer was not arrested or imprisoned during questioning about fence cutting during the NFO all-out holding action last September. The defendants testified the boy was heard talking about cutting fences. Kilmer is an NFO member. The elder Kilmer filed suit through his son. Carson ruled the sheriff acted in his duties and the plaintiff failed to prove damages or false arrest. The decision may be appealed.
