Refund Overcharge In Auction Of Tractor
The first court action of its kind concluded when a $554 check was received by the District OPA, representing the amount above the ceiling price paid for a tractor sold last June at West Berne. Charles Steadman, Schoharie County auctioneer, sold Wesley Deats farm goods on June 12. Harold E. Smith bought a used tractor for $970. James F. Carroll, enforcement attorney, filed Supreme Court action in the name of Prentiss Brown, administrator, against Steadman and Deats. The case was settled and the check sent. Only the government can sue under the regulations when a person buys machinery for business.
