Court Strikes Down Defense Worker Ban on Reds
The Supreme Court ruled 6-2 that the Subversive Activities Control Act provision barring Communist-action group members from defense plants is unconstitutional as an abridgment of the First Amendment. Chief Justice Warren said guilt by association cannot stand. Dissenters White and Harlan dissented. Marshall did not participate. The decision preserves free association while noting Congress may narrowly target threats to defense facilities. The court also agreed to review a school desegregation freedom of choice plan and rejected other labor and corporate challenges.
