Housing Exporter Granted Broader Powers Against Rent Violations
The Housing Exporter gains authority to seek injunctions for violations of the rent law beyond overcharges, including unlawful evictions. Tenants retain rights to sue for up to three times the overcharged amount plus court costs and attorneys fees.
Eviction Rules Narrow Under 1948 Housing Law
The 1948 act limits evictions by requiring 60 days after written notice unless rent is unpaid or tenancy duties breach. Grounds include owner occupancy, sale to owner, demolition or substantial alteration, withdrawal from rental market, public improvement leases, or non profit housing staff use. Decontrolled units include hotels, transient motor courts, trailers, and certain pre 1947 constructions.
