New Orleans, April 7 uP A New York soldier court martialed and convicted on charges of sedition and speaking disrespectfully of President Roosevelt must serve a ten year prison term. Hugh Callan, 36, native of Ireland naturalized in 1936, was court martialed at Camp Blanding, Florida, and given a 20 year term later reduced to ten years by the president. He was convicted on two counts of disrespecting the president and five counts of sedition based on statements made in the presence of enlisted men that the Allies were in the right and that the United States was vulnerable. Callan obtained release from Atlanta federal penitentiary through habeas corpus, contending the court martial lacked jurisdiction. Federal Judge Be Marvin Underwood held he was not inducted into the army within the selective service law.
