Oklahoma Capital Location Decision Syllabus Summary

The Oklahoma capital location dispute centers on the 1906 enabling act and the 1908 ballot provisions. The court holds the act gave Guthrie a temporary capital, restricting moves before 1913, and that the governor cannot lawfully enforce actions to relocate the capital without a proper adopted law. The ruling upholds the governor’s restraint, notes the state’s sovereignty to enact laws consistent with the U.S. and state constitutions, and finds the attempted actions without lawful authority would risk unlawful state expenditures.
