Indians May Recover Taxes In Indian Territory Suit
Oklahoma City May 24 A number of suits are being prepared for owners of land in the former Indian Territory to recover taxes legally collected by the state. Attorney W A Ledbetter said the principal case is George W Choate et al versus M E Trapp secretary of state board of equalization and county officers. It involved about 8000 allottees who claim their lands were not subject to taxation and sought to enjoin the assessment and collection of taxes. The decision holds that county officers erred in applying state tax laws and that Indians retain private property rights and all constitutional guarantees.
