Cleveland sentenced to fifteen years for second degree murder
Jack G. Cleveland member of the county board of revenue and commissioners was convicted on February 91 of murder in the second degree for the killing of Lossing an 89 year old resident of Fowlriver on August 24. Judge Turner sentenced him to fifteen years in the penitentiary and noted a motion for a new trial filed by the defense. The court indicated it would rule on the motion April 19 and discussed whether the motion suspended the sentence. The defense claimed the motion did not suspend the sentence. the court ruled no stay on the sentence was granted. The defense argued errors and asked for a stay, but the court refused to grant the stay and proceeded with sentencing. Judge Turner, from Chatom Washington county, had been awaiting the defense decision before passing sentence and returned to Mobile to act in the case.
