Court Reaffirms Tax Debt Obligation For Solvent Credits
NTGOMBERY June 11 Special The Alabama Court of Appeals upholds the Montgomery city court ruling that taxpayers who held solvent credits before the statute repeal must pay prior solvent credit taxes. The decision rejects the retroactive doctrine and confirms tax liability for pre repeal cases. The court also affirms the Bessemer case Louisville Nashville v. Fritz Risenstein, ruling a railroad cannot limit intrastate damages in contracts.
