Possession after contract upholds suit for wheat value
The Appellate Court ruled that a possessor who enters land under a contract and remains in possession beyond its term becomes a tenant under the contract. The suit sought wheat value from Hannum on Ridgeway’s land. The Supreme Court affirmed that Indiana code adoption preserved the writ of assistance for foreclosure buyers to obtain possession, abolishing old legal equitable distinctions.
