Dissenting views urge test of mortgage deduction law

The minority of the Supreme Court, led by Judge Dowling and joined by Judge Monks, dissents in the mortgage deduction case. They argue the law is unconstitutional for four reasons including violation of equal privileges, its special tax assessment nature, lack of uniformity in rates, and exemption of non public-use real estate. The opinion notes the governor’s doubts, calls the act sporadic, and stresses that general taxes follow the property, not the owner, undermining uniform taxation.
