Subsidy Tax Upheld by High Tribunals in Interurban Case

The Appellate Court, in Judge Roby’s opinion, ruled that Pleasant township’s $34,000 subsidy tax to aid the Indianapolis Greenwood and Franklin interurban line is valid and collectible. Taxpayers Demaree and others sought an injunction, arguing the company, chartered under the 1853 commercial railroad law, could not build such a road or carry freight. The circuit court upheld a demurrer. Roby notes the Board of Commissioners found conditions met and their order blocks collateral attack. The decision contends the corporation’s powers remain intact and that damages provisions protect individuals. A separate Soapy Court opinion held the receiver of a building and loan association must return assets for taxation, reversing Marion County’s prior ruling. Also noted is a finding that Benjamin Jifford acquired valid title to land in Jasper County from the state auditor’s sale to satisfy a loan to James Light.
