Appeals court orders dismissal of Flynn prosecution

The U S Circuit Court of Appeals for the District of Columbia ordered the dismissal of the criminal case against Michael Flynn, overturning a district judge’s scrutiny of the Justice Department’s move to drop the prosecution. The ruling bars further challenge to the department’s decision and heightens political debate over Barr, Mueller, and the Russia investigation. Flynn had pled guilty to lying to the FBI but sought to contest the government’s motion to dismiss. The panel held prosecutorial charging decisions rest with the executive branch, rejecting grounds for broader inquiry. Flynn is the sole White House official charged in Mueller’s probe.
