Dayton Power & Light Co contests Ohio eight month old coal excise tax before the Ohio Board of Tax Appeals alleging it violates the U.S. and Ohio constitutions. If upheld, many similar levies on investor owned utilities remain valid though OP&L will appeal to the Ohio Supreme Court. The tax applies to coal purchases over 200 tons with rates from 15 to 40 cents per ton, higher sulfur content reducing the tax to promote cleaner coal usage.
