Man pleads for chair as girl killer is jailed
Smith, 19, pleaded Tuesday to be sent to the electric chair for the murder of year old Mary Ellen Babcock but was sentenced to life imprisonment in Attica. The judge rejected the insanity plea after a jury found him guilty of a first degree murder. Smith told the court he was sane and requested the chair to end his misery. This marked the first time a defendant could seek life instead of death under a new state law.
