Mills Case Holds NRA Act Inapplicable To Local Gas Stations
In Baltimore on July 13 Judge W Calvin Chestnut ruled Herman Mills, operator of gas stations in Hagerstown Frederick and Chambersburg, did not engage in interstate commerce and therefore the National Industrial Recovery Act could not force him to stop giving premiums with gasoline sales. The decision dismissed an NRA injunction and noted constitutional rights protected individuals while recognizing the code’s reach over interstate petroleum trade. Mills had refused to discontinue the practice despite NRA warnings. the order also cited a separate $100 fine for a lumber dealer refusing to sign the lumber code on religious grounds.

Johnson Will Not Retract Remarks About Germany
