Federal appeals court halts Berry execution pending S Ct ruling

In Cincinnati the 6th U S Circuit granted a request by The Volunteer to stay execution while final appeals await the Supreme Court. Wilford Berry Jr 35 known as The Volunteer has said he would rather die than spend life in prison for killing his employer Charles Mitroff a Cleveland baker in 1989. His mother and sister contest his competence and Ohio Supreme Court has ruled he is competent to choose death. If carried out it would be Ohio s first execution since 1963. The court had earlier upheld Berry s competence to drop appeals.
