Legal Question From Vote Machines in State Supreme Court

A legal contest over the Republican nomination in the August primaries for the six week term on the State Supreme Court raises whether candidate names must be rotated on ballots when voting machines are used. Frank H. Ward seeks a writ to place his name ahead of G. K. Allen on the November ballot, arguing head placements favored Allen in Trumbull county. Ward asserts Allen led by 2,457 votes with total county plurality of 817 and alleges irregularities in 15 cases. The Supreme Court granted an alternative writ and set Sept. 17 for a response, noting this is a new judicial question despite older attorney general opinions against rotation when machines are used.
