Ohio Supreme Court bans using a suspect's attorney request as guilt proof
The court ruled unanimously that prosecutors may not introduce a suspect's request for legal counsel as evidence of guilt, upholding a lower court order for a new trial for Thomas Leach, convicted in Hamilton County of an attempted rape. The decision centers on whether silence or requesting a lawyer can be used to infer guilt, affirming protections against self incrimination.
