Court rejects Dayton busing order in desegregation ruling

The Supreme Court ruled lower courts overreached in ordering forced busing for about 18,000 Dayton pupils. It sent the case back for a narrower remedy, keeping the current desegregation plan in force for one more year while courts adjust. The decision limits federal judges' powers without establishing new constitutional grounds. The Dayton plan had mandated busing to achieve a districtwide racial balance. Based on the district's makeup, white students were 32 percent and Black students 48 percent.
