Supreme Court denies exemption for private clubs smoking ban
The Ohio Supreme Court rejected the Ohio Department of Health appeal to exempt veterans halls American Legion posts and other private clubs from the 2006 smoking ban. The ruling keeps the law banning smoking in most public places and upholds a lower court finding that the Health Department lacked authority to create club exemptions. The Ohio Licensed Beverage Association backs the decision, arguing private club exemptions would be unfair.
