City Solicitor Backs Rejecting Falbo Claim Over Sewer Work

City Solicitor Edward J. Conley advised the council to reject a $150,000 claim by Falbo Construction Co. for losses on the east side siphon sewer project. He said Falbo’s own efforts caused any damages and that the city should not be liable. Engineers Jones, Henry, and Williams argued Falbo bore the risk, noting no changed conditions. The council meeting will hear the opinion alongside a note that about $16,000 remains encumbered and unexpended in the construction account.
