Lawyers for Rep. Dan Rostenkowski argue the government corruption case intrudes on legislative business and seeks to dismiss some counts based on immunity under the speech and debate clause. They say Congress alone defines legitimate official purposes, while the executive and judicial branches cannot intervene. The Third Circuit has ruled the clause does not shield members from bribery prosecutions in a related McDade case.
