Judge weighs delaying murder case for fair trial test
Elyria Lorain County Common Pleas Judge John Miraldi opened a hearing to decide if a balancing test is needed to assess whether Robbie New can receive a fair trial after a long delay. The 2011 indictment stems from Dorothy Spencer's 1976 death, ruled compromised by time by a former judge, later overturned on appeal. He seeks input from prosecutors and defense on the delay impact. Several witnesses and relatives connected to the case have since died.
