Merck Wins Federal Vioxx Case in Irvin Heart Attack Fight
A federal jury cleared Merck & Co. of responsibility for the death of 51 year old Richard Irvin after he used Vioxx for under a month in 2001. The verdict found it more likely than not that Vioxx contributed to the heart attack but did not prove sole causation. Judges and plaintiffs focused on warnings and design risk while noting prior VIGOR data showing higher heart attack rates. Irvin’s family argued Merck should have warned earlier. Merck said factors like age and diet explained the risk.
