Solicitor Rules on Pay Withholding at City Park Dept

Solicitor J C Tattersall ruled the city need not pay 117.65 dollars withheld from a park department employee if the work violated a commission directive. He warned the park commission could unjustly enrich itself at the employee and city’s expense. The commission said only three fulltime workers would be used in early 1963 to align with a tightened budget. Park Supt Machock claimed no formal notice before January 10, leading to a contested layoff. The panel voted to withhold pay for work after January 4 but approved compensation for work performed January 1 to 4.
