Court rejects Ohio's second parochial school aid plan
A three judge U S District Court panel in Columbus ruled Ohio's tax refund plan for aid to parochial schools unconstitutional. The court found that despite its form the aid primarily benefits a sectarian school class and thus violates church state separation. The suit, filed by the Ohio Chapter ACLU, signals potential national implications and possible appeals through higher courts. The plan would have allowed 61 million dollars in aid to non public schools via state tax credits through June 30, next year.
