Attorney Gerald Phillips representing former streets superintendent William Biro pressed Avon Mayor Jim Smith to resign at a City Council meeting calling the move to dismiss Biro an abuse of power. Smith rejected the demand, noting he rehired Biro after a 2010 firing. Biro appeals the January firing and a private Civil Service hearing officer will decide by next Friday.
