City employee fights retirement reinstatement case notes

Common Pleas Judge Floyd D. Harris took under advisement the second move by George J. Ross former Elyria Health Department sanitarian seeking reinstatement. Ross says he was illegally fired due to a 65 retirement rule adopted by the Board of Health in March 1977. Health board member Earl Wammes testified the rule followed city cost cuts amid tight finances and a council ordinance setting 65 as retirement age. Ross and another health department worker lost their jobs under the rule. Attorney John Haynes for Ross argued the ordinance invalid and the board action illegal. Attorney Robert Corts for the Health Department argued the department operates apart from council authority. The court set brief deadlines to May 1. Ross first filed the suit last July and it was dismissed then at Corts request for lacking the Ohio attorney general as a defendant.
