Court Finds Treasurer Could Not Tie General Funds in Time Deposits

In Burleigh County last Monday Judge W L Nuessle ruled that the county treasurer had no right to lock county money in the general fund as time deposits but could place funds in the sinking fund as needed to pay obligations. The Bank of North Dakota was named a legal depository and need not furnish collateral before deposits. The court’s sole doubt concerned retiree treasurer ties that prevent the successor from paying county debts. The hearing grew from a mandamus petition demanding the retired treasurer return about 200000 deposited with the Bank of North Dakota in timed certificates. A final decision is expected later in the week. The case backs a Burke County suit and could influence that action as bankers decried the move to shift funds to North Dakota banks. Meanwhile, Treasurer Jansen works to clear warrants and restore monthly state tax reports to the state auditor, with substantial sums in hail and general tax funds awaiting disposition.
