Beauty of the Law and Major Harrold’s Award Battle
Major John T Harrold injured on New York elevated railway at For by second Street and Third Avenue March 25 1874. After protracted litigation against New York Elevated Railway Company a verdict of 10400 and costs and 1000 extra allowance was recorded. The company appealed and the Court of Appeals upheld the original verdict while the matter of payment was delayed by stays and injunctions. Trial then exposed alleged conspiracy and perjury by witnesses with Dr Shine defending the company. After successive court rulings the money was ordered paid but the attorney fee dispute left Harrold without funds. Judge awarded Shaffer 31722915 costs and disbursements and 5054 advances and interest, leaving Harrold with 14515 (the article notes further complications over doctors fees). Meanwhile seven physicians testified and the prize money remains locked until doctors bills are settled. The case draws out a moral on litigation costs and vindication.
