New trial ordered in Prudencio death case

District Judge Caldwell ordered a new trial for Freddie and Tessie Prudencio who seek 6.5 million over Yolanda Prudencio’s death after she fell from a rolling school bus in January 1985. Affidavits allege bailiff Martinez, brother-in-law of two defendants, pressed jurors. Defendants include Faust’s Transportation owners Faustin and Flora Gonzales Virginia Valencia and her husband Merlin Valencia. The January verdict found no negligence by the Valencias but negligence by the Gonzaleses, with disputes over proximate cause. Martinez allegedly sought jurors’ foreman vote and met jurors’ families at lunch. The defense had argued the bus brakes caused panic and jumping.
