Medicare change undercuts patient private financing effort
The Balanced Budget Act of 1997 includes section 45-07 forcing physicians to file affidavits promising not to submit Medicare claims for two years to privately finance care for any Medicare patient. This defeats the aim of allowing private contracts outside Medicare and keeps all patients on Medicare. Senators Kyl and Representatives Archer and Thomas have proposed HR 2497 and HR 1194 to allow private arrangements without leaving Medicare.
