Judge rules for and against Viale in Auburn debt case
In U.S. District Court in Auburn Judge Edmund Port ruled Regional Collection Services violated the Fair Debt Collection Act by not informing Viale of his right to dispute a $15.50 X-ray bill for his son. He awarded Viale $250 in damages but found the action was brought in bad faith for harassment and ordered Viale to cover the defendants’ attorney fees. Fees may be settled by July 22 or motion hearings will occur. The case also dismissed Viale’s action against C I M Radiology Group Inc.
