Lusk warns 20 degree slope limit would curb WV strip mining
A West Virginia industry spokesman says a 20 degree slope ban proposed by Congress would eliminate 65 to 70 percent of state strip production. Ben Lusk, executive secretary of the WV Surface Mining and Reclamation Association, notes that northern mines could be endangered if permits mix slopes under and over 20 degrees. Governor Moore has not committed to a special session to consider a road bond issue.

Challenge to levy revealed
A coal mine operators group plans to file a suit in Franklin Circuit Court challenging Kentucky's coal severance tax as unconstitutional and discriminatory. They argue the tax applies only to coal extractors and not to other minerals and seeks to bar enforcement against entities not actively mining coal. The 4 percent or 30 cents per ton levy took effect April 1, 1972.
