United Presbyterian Sues Anna Church Over Property
The United Presbyterian Church in the United States of America filed suit in Union County circuit court to claim land and church property from the First Presbyterian Church of Anna after the Anna congregation withdrew in October over doctrine. Rev. Clair Albright says the split was driven by UPCUSA’s liberal stance on homosexuality and ordination of nondivine belief ministers, and that the withdrawal aimed to safeguard property. The suit seeks a ruling that the withdrawal is null and ownership rests with UPCUSA, while Albright calls it an implied trust not approved by the general assembly. he cites a 1979 Supreme Court ruling overturning the implied trust argument.
