Supreme Court limits cross examination of rape accusers in Illinois

The Illinois Supreme Court on a 6-1 vote barred a rape defendant from cross examining an accuser about her sexual past when the acts were not linked to the case. The decision upholds the 1978 rape shield law restricting testimony on past sexual conduct unless it involves the defendant or a constitutionally required exception. The Santos case affirmed that DNA evidence showing non-consent factors can shape, but not authorize, such lines of questioning. Santos remains entitled to a new trial, with jurors to hear that the accuser was under 17 at the time.
