Supreme Courtbolsters civilian trials for service members
The Supreme Court ruled 4 3 that servicemen can be tried in civilian courts for crimes unrelated to military duties, limiting military courts authority. Justice Douglas said military discipline needs a special system but not at the expense of grand jury and peer jury rights for service members on leave or off post. The test case involved Army sergeant James F. O Callahan in Hawaii for an attempted rape, sentenced to 19 years. An Alabama convict, Edward Boykin, won reversal after the court found the guilty plea lacked voluntary and informed consent.
