Supreme Court curbs pretrial press censorship powers
The Supreme Court on June 30 ruled unanimously that judges cannot bar pretrial publicity in criminal cases. The decision struck down a Nebraska judge’s order restricting reporting of a mass murder case, noting the heavy burden to justify prior restraints and preserving editor discretion over publication. Justice Burger led the ruling with Justices White Blackmun Powell Rehnquist concurring, while Brennan Brennan and Marshall warned such restraints are constitutionally impermissible.
