Eligibility Of Ham For Sidney Council Goes To District Court
Ham elected April 5 to Sidney City Council was denied the right to serve because the City Manager form of government is deemed to place him in public employ. He sues to challenge the statutes as unconstitutional under the 14th Amendment, arguing the law grants exclusive privileges and is vague. The case, to be heard by District Judge John H. Kins, could attract broad state interest and likely move toward the Supreme Court.
