Law Unconstitutional County Action On Community College Tax

The act consolidates junior colleges and vocational schools into eight districts, with counties facing a one mill levy and 75 percent state funding. Simmons notes new language centralizes control and may still violate the Duis amendment by using local taxes for a state function. He recommends naming Sioux, Dawes, and Scotts Bluff as co-defendants to affect all areas, while Sen Robert Clark urges proceeding to determine constitutionality and warns of potential liabilities for commissioners. County Attorney Don Tedesco advises setting the levy and avoiding guessing games.
