Land Office Decisions on Homestead Entry and Rights
The article states that submerged land in navigable streams lacks entry authority and that entry qualifications must exist at filing date. Rights from filing can be lost if disqualified before entry. It notes surveyor general findings do not preclude rights or facts, and practice is not altered by state procedure. Residence starts when a settler occupies land with intent to reside. Contests may allow withdrawal and new evidence before further action. Entry for another’s benefit is fraudulent and cancelable. Rights do not extend to lands reserved by competent authority.
