Supreme Court Sustains Tapper Water Right Contract
The court holds that the respondent undertook to furnish a fixed water right under a Carey Act style contract, despite drought year 1915. Purchasers relied on a 3000 cubic feet per second supply and rights to a proportional share in the irrigation system, and damages may be sought for failure to deliver. The decision reverses lower rulings and remands for damages determination.
