The draft constitution strengthens checks on executive and administrative agencies with a new Declaration of Rights protecting fair treatment in investigations and hearings. It also adds a Legislative Article provision allowing a joint committee to suspend agency rules when the legislature is not in session, enabling a legislative check during breaks.
A new section to the Judicial Article provides direct court review of final decisions and orders by administrative officers or agencies that affect private rights or licenses. It requires assessment of legal authorization and whether evidence supports the decision, with exceptions for workmen’s compensation findings and some property tax appeals.
