Supreme Court Delays Flynn Olyphant Contested Election
The Supreme Court handed down two Lackawanna county decisions. One concerns the contested Third Ward councilman election of James J. Flynn of Olyphant where Edward Hurke initially trailed by two votes after a recount. Four imperfectly marked ballots were counted, giving Hurke a two vote lead, and the court issued an alternative mandamus but did not seat Hurke. The case was postponed to February 1907 for further argument as Flynn’s counsel sought a certiorari. Flynn has held office over two years. The other Flynn v Jacobs ruling cancels the damages rule and awards damages, attorney fees and costs under the May 25, 1874 act.
